Typically detainees will be released the same day the bond is paid. In approximately 1-3 months after their release, the detainee will receive an immigration court hearing notice with their first court date. (It is very important detainees maintain a correct address on file with Immigration to receive all important information. If a detainee fails to appear for a court hearing because he/she did not receive notification, this could result in an automatic deportation and forfeiture of collateral.) It is highly recommended a reputable immigration attorney be retained. Monthly payments will begin 1 month from the bond contract date. After successful completion of all appearances and requirements, Immigration will close the bond. We will contact the cosigner and/or detainee and return all collateral immediately.

"What if I want to leave prior to the scheduled court date?"

After bonding if you wish to leave the country you can, BUT you must follow certain guidelines. You do not have to wait for your court date. You can go to immigration court and ask to be "put on the docket". If placed on the docket, you can ask the judge for a voluntary departure. (A voluntary departure does not count against you as a deportation does.) The judge will typically grant you this and will give you a departure date. This is the date by which you will need to leave the country. Prior to leaving, you need to obtain a "verification of departure" form from Immigration and Customs Enforcement. There is no charge for this form and you obtain it by going to the nearest ICE office. They will take your photograph and fingerprint and attach it to this form. It will also have the date of departure listed. Once you have this form, you may leave at any time PRIOR to the departure date. You must take this form to the US consulate in your native country. They will sign and date it. Ask for a copy and mail a copy to someone who can take it the the Immigration office where it originated. When the information is confirmed, your bond will be cancelled.

If you fail to follow this procedure and "just leave", there will be no record of your departure and you will be considered a fugitive and have an order of removal (deportation). Your bond will be breeched and all collateral placed against your bond could be lost.
